Setting Up a Pharmacy Chain? Here’s What You Must Register First

Blog Article

Starting a pharmacy chain in India is a promising business venture, especially with the growing demand for accessible healthcare. However, before you launch your retail or wholesale pharmacy outlets, navigating through the necessary regulatory approvals is essential. Here’s a detailed look at what you need to register first before opening your pharmacy chain.

1. Business Entity Registration

Your first step is to register your business legally. Choose a structure that aligns with your goals—such as a Private Limited Company, LLP, or Proprietorship. A private limited company is often preferred for scalability and investment purposes. You must register your entity with the Ministry of Corporate Affairs (MCA) and obtain a Certificate of Incorporation.

2. GST Registration

If your annual turnover exceeds the threshold limit or you're planning inter-state operations, GST registration is mandatory. A valid GST number is required for issuing invoices and tax compliance across your supply chain.

3. Drug License (Wholesale/Retail)

This is the most critical registration for your pharmacy chain. You must apply for a Wholesale Drug License or Retail Drug License depending on your business model. These licenses are issued under the Drugs and Cosmetics Act, 1940 by the State Drug Control Department.

To apply, you’ll need:

  • A qualified registered pharmacist or competent person (with experience or diploma/degree in pharmacy)

  • Proper storage infrastructure (such as refrigerators for certain medicines)

  • Details of premises (ownership/rental agreement)

  • Identity and address proof of the applicant

  • Business constitution documents (MoA, AoA, Partnership Deed, etc.)

If you’re setting up multiple outlets across different states, you’ll need a license for each location.

4. FSSAI License (if selling food supplements)

If your pharmacy chain will also sell nutraceuticals, dietary supplements, or energy drinks, an FSSAI license is mandatory. These products fall under food regulations, and FSSAI compliance is crucial to avoid legal issues.

5. Trade License

Issued by the local municipal authority, a Trade License certifies that your pharmacy is permitted to carry out business in a commercial space. You’ll need to submit this along with the layout plan of your premises and other details.

6. Shops and Establishment Registration

This is a state-level registration that regulates working conditions, operating hours, and employee welfare. It’s generally required within 30 days of starting your pharmacy.
